HERNÁNDEZ, District Judge:

Plaintiff Johnny Davis brings this employment discrimination action against -his former -employer, Defendant • Con-Way Freight, Inc.1 Plaintiff claims that Defen*1226dant discriminated against him because of his perceived or actual disability, in violation of ORS 659A.112. In addition, Plaintiff brings a claim of wrongful discharge, alleging that he was terminated for invoking his right to health care benefits.
