Defendant was indicted by the grand jury of Lyon county charged with the crime of manslaughter in the second degree, tried in the district court for that county before Olsen, J., who at the close of the testimony denied his motion for a directed verdict, and a jury which found defendant guilty. From an order denying his motion for a new trial, defendant appealed.

Defendant was convicted of second degree manslaughter, charged to have been committed by driving an automobile at excessive and unlawful speed against a car in which Ingra T-horson was riding, thereby causing ■her death. He appeals from the order denying a new trial.
A state road runs north from Slayton to Tracy. A short distance south of Tracy it is crossed at right angles by another road running east from Balaton to Walnut Grove.
