This appeal comes from the county court of Hughes county. W. D. Diamond sued the Missouri, Oklahoma & Gulf Railway Company. ' The plaintiff alleges that the company, on the 28th day of August, 1910, took and converted to its own use a number of fence posts of the value of $60, and in the month of February cr March, 1911, a number of cross-ties of the value of $33, the property of Diamond, and prayed judgment for $93, and interest. The company answered by general denial. The case was tried to the court and jury January 30, 1912, and resulted in a verdict for the. company.…
