In this appeal, Piero A. Sassu challenges the order of the Court of Common Pleas of Montgomery County (trial court) sustaining the Borough’s 1 preliminary objection, in the nature of a demurrer, to Sassu’s Complaint. On appeal, Sassu claims that the statute commonly referred to as Act 600 2 entitles him to a mandatory pension benefit and that the trial court did not accept as true all of the well-pled factual allegations, including exhibits, in Sassu’s complaint.
