In a negligence action *375to recover damages for personal injuries, the defendant appeals from an order of the Supreme Court, Nassau County (Mc-Cabe, J.), dated May 30, 1996, which, inter alia, granted the plaintiffs motion for summary judgment on the issue of liability after striking the defendant’s answer pursuant to CPLR 3126.

Ordered that the order is affirmed, with costs.
