This is an action by Peter Macchi against the Portland Railway, Right & Power Company, a corporation, for personal injuries resulting from a collision with a street-car in Portland, Oregon. 1-3. The first assignment of error involves the admissibility of evidence. Henry Meeve, Ida Enkeles, Rebecca Bareli and Lewis Pitts, witnesses for plaintiff, were permitted, over the objection of the defendant, to testify that the street-car, at or just before the time of the accident, was traveling faster than cars ordinarily ran in the City of Portland; and it is insisted that the admission of such evidence was prejudicial error.
