Defendant, Ned Owens, was indicted for the murder of Frank Davis. (Ill. Rev. Stat. 1971, ch. 38, pars. 9 — 1 and 9 — 1(a-2).) He was found guilty by a jury and sentenced by the court to 30 to 60 years imprisonment.
