On September 3, 1996, Defendants Key-Bank National Corporation (“KeyBank”) and Lake City Bank of Syracuse, Indiana (“Lake City Bank”), acting as personal representative for the Estate of Ernestine V. Ursehel, each filed a motion for summary judgment pursuant to Rule 56 of the Federal Rules of Civil Procedure.
