GARDNER, Chief Judge.
This is an appeal from a judgment which dismissed appellant’s action on its merits. The parties will be referred to as they appeared in the trial court. The action was to recover damages for the wrongful death of plaintiff’s decedent as the result of an automobile accident. Plaintiff is the special administrator of the estate of Marilyn Peterson, deceased, who at the time of *412her death was fifteen years of age and resided with her parents in South Dakota.
