The defendant, Claude Warrenburg, is confined in the county jail of Grant county, and has filed a petition for release by habeas corpus.

The facts show that the defendant was charged by complaint filed in the justice of the peace court in Grant county on November 30, 1936, with the crime of burglary in the second degree, for breaking into a building in the town of Salt Fork, Grant county, for the purpose of stealing $35 worth of barber equipment.
