On December 4, 1980, Or Da Industries, Ltd. filed an involuntary petition which seeks an order for relief under chapter 7 of the Bankruptcy Code against Skye Marketing Corporation, the alleged debtor. In the creditor’s petition, it is alleged that Skye Marketing has fewer than twelve creditors, and that the petitioning creditor holds a claim of $178,409.62 which is not contingent as to liability.
