Affirming.

The General Assembly of 1902 passed an act entitled “An act authorizing the establishment of free public libraries in cities of the second and third classes.” Acts 1902, chapter 70, page 155. It authorizes the establishment and maintenance of a public library in each of such cities, and provides for the levy and collection of certain taxes, and makes certain appropriations for such establishment and maintenance. It creates a board of trustees of such library and constitutes the same a body politic and corporate, with perpetual succession.…
