MEMORANDUM OPINION AND ORDER
ASPEN, District Judge:
Plaintiff Marc Austwick (“Austwick”) brought this action against the Board of Education of Township High School District # 113, County of Lake (“defendant”), alleging that state and federal constitutional rights of Austwick and others similarly situated were violated by defendant’s policy of permitting reduction of students’ grades for unexcused absences and tardiness.
