The plaintiff, through an appeal from the board of zoning appeals of the City of New Haven, presents the question whether the board acted within the well-known principles governing such an administrative board in denying the plaintiff’s application.

The application involved the use of a barn with dimensions of 35 by 60 that had been recently purchased by the plaintiff, after inquiry by him of a clerk in the office of the building department elicited the answer that the property could be used for a commercial use.

In fact it had been so used, but not until after the adoption of the zoning…
