MEMORANDUM OPINION ON PLAINTIFF’S MOTION FOR SUMMARY JUDGMENT

This Adversary proceeding relates to the bankruptcy case filed by James and Alice Kusmierek (“Debtors”) under Chapter 7 of the Bankruptcy Code, 11 U.S.C. § 101 et seq., on January 15, 1997. The Adversary was filed on April 24,1997, by Debtor’s sister Karen Kress, as personal representative of the estate of Debtor’s mother Freda Kus-mierek.
