This appeal comes to this court on questions of law from a judgment and decree entered for the defendant on the defendant’s cross-petition and dismissing plaintiff’s petition. The original action was for alimony. The defendant’s answer denied all the allegations of the petition and by cross-petition, designated “cross-petition for a declaratory judgment declaring the status of the parties,” prayed for a declaration of the marital status of the parties. No service of any kind was had on the cross-petition.
