MEMORANDUM OPINION

Hearing was held October 12, 2005, on the motion of Western Surety Company to approve payment to it of contract funds arising under two pre-petition construction contracts of the debtor, Jones Construction & Renovation, Inc. Western Surety also asserts its right to debtor’s claim against the owners of one of the projects, Christopher Newport University. The trustee opposes the motion.
