The defendant has been charged by an eight-count indictment filed on November 24, 2000 with attempted murder in the second degree as a hate crime and related offenses. On or *188about December 21, 2000, the defendant filed a timely omnibus motion seeking various relief. The People responded to the motion which was decided by the Court on or about January 17, 2001.
