Appeal from an order of the Court of Claims (McCarthy, J.), entered December 2, 2011, which, upon reargument, granted defendant’s cross motion for summary judgment dismissing the claim.
In 1993, claimant pleaded guilty to one count of robbery in the first degree and was sentenced to a prison term of 10 to 20 years. Based upon his prior felony convictions, which were recounted in the presentence investigation report, claimant was eligible to be sentenced as a predicate violent felony offender.
