Joseph Marion Davier filed a bill in the circuit court of Hancock county against the heirs and devisees of Mary E. Davier and the executor of her will, the prayer of which was that the court decree the specific performance of an alleged contract by Mary E. Davier to make a will giving all her property to the complainant, and that the executor of her will be decreed to hold the title to such property in trust for the complainant and to convey it to him.
