Archie Tappato, 22 years of age, met his death between 9:30 and 10:30 A.M., November 21, 1935, by falling down an elevator shaft. His employer, the defendant, occupied the fifth and sixth floors of a six-story building on Market Street, Philadelphia. Decedent worked at a machine on the sixth floor, stitching pants and “clams.” The fifth floor was used as a cutting and shipping room and for other work as well as for offices.
