Gravatt v. Regence Blueshield
Idaho Supreme Court
1Opinion of the Court
SCHROEDER, Justice.
Troy Gravatt (Gravatt) was insured under a policy with Regenee Blue Shield. The question presented to the district court was whether he had a preexisting condition at the time the policy was issued that precluded him from coverage until a waiting period had passed. On cross-motions for summary judgment the district court ruled that Gravatt did not have a preexisting condition and that he was not precluded from coverage by the waiting period. Consequently, he was covered under the policy of insurance. The decision of the district court is reversed.
