Appeal from a judgment of the Supreme Court (Torraca, J.), entered February 28, 1990 in *905Albany County, which granted petitioner’s application, in a proceeding pursuant to CPLR article 78, to annul a determination of respondents denying petitioner’s request for a redetermination of his retirement status.
