The defendant-petitioner, Norman Brabson, has appealed directly to this court, by permission of the Chief Judge (People v. Brabson, 8 N Y 2d 913), from an order of the Court of General Sessions, New York County, denying, after a series of hearings, his motion for a writ of error coram nobis to vacate and set aside a judgment of death rendered June 24, 1940, following a trial by jury in the Court of General Sessions, wMch judgment was affirmed by this court by a divided vote.
