VAN GRAAFEILAND, Circuit Judge:

In 1973, a special grand jury was investigating harness racing in the New York metropolitan area. Several of those who came under investigation were indicted and convicted of sports bribery. See United States v. Gerry, 515 F.2d 130 (2d Cir. 1975). Others were indicted and convicted for lying to the grand jury. See United States v. Turcotte, 515 F.2d 145 (2d Cir. 1975). Appellant falls within the latter group. He was convicted of perjury (18 U.S.C. § 1623) 1 for falsely testifying about the ownership of a horse and his relationship with Forrest Gerry, one of the…
