Avery Allen Baxter appeals from the district court’s 1 adverse grant of summary judgment to his employer, Whirlpool Corporation (Whirlpool), and to the United Paper-workers International Union and its Local 7370 (referred to collectively as UPI) in his action for unfair representation and breach of the collective bargaining agreement (CBA). We affirm the judgment of the district court.
