Appeal by the plaintiff, Harry W. Putnam, from a judgment of the Supreme Court in favor of the defendant Siravo, entered in the office of the clerk of the county of Richmond on the 25th day of March, 1910, dismissing the complaint after a trial at the Richmond Special Term.

This action is brought to foreclose a mechanic’s lien. At the opening of the case for trial the defendant moved to dismiss the complaint upon the ground “ that there is no allegation contained therein that the plaintiff herein is a duly licensed and registered *195plumber under the laws of the State,” and on the further ground that there is no allegation contained in the complaint that prior to the commencement of the work the plans and description thereof were filed in the department of buildings of the city of New York, or approved by the superintendent of buildings, as required by…
