Before the Court is the Defendant United States of America’s motion to dismiss under Federal Rule of Civil Procedure 12(b)(1) or for summary judgment under Rule 66(c). This action is brought under the Federal Torts Claims Act (FTCA), 28 U.S.C. §§ 2671-2680, for damages arising out of a tragic automobile accident caused by drunken Coast Guardsman Mark David Brown.
