In an action to recover damages for injury to property, the plaintiff appeals from an order of the Supreme Court, Queens County (Durante, J.), dated November 13, 1985, which granted the motion of the defendant for partial summary judgment dismissing the third cause of action in the plaintiff’s amended complaint pursuant to General Obligations Law § 5-322.1.
Ordered that the order is reversed, on the law, with costs, and the motion is denied.
