SIMONS, Circuit Judge.
The insurance company in a contract with the appellant’s decedent, undertook to *24pay the appellant, as beneficiary, $10,000 in the event of the insured’s death, and an additional $10,000 if the insured died “in consequence of the destruction, by fire, of a building while the insured is therein,” the latter provision being scheduled under the heading “Double Indemnity.” It is the applicability of this provision to the circumstances causing death that presents the sole issue on the appeal, the district court having decided that the appellant was not entitled to double…
