This is an application for a writ of prohibition.
On December 6, 1909, Fred L. Hilmer and others who had been candidates for the office of supervisor of said city and county at a municipal election held November 2, 1909, instituted a contest, contesting the election of petitioner and the other seventeen candidates declared elected, on the ground that they did not receive the highest number of votes cast.
