Ben A. Stewart brought an action in the county court of Rock Island county against David Brady, who filed a demurrer to the declaration, which was overruled. The defendant electing to stand by his demurrer, the court assessed the damages and rendered judgment against him for the sum of $313.33, from which he appealed to this court on the ground that the constitutionality of the Illinois Securities law is involved.
