In this action to recover damages for personal injuries under the Federal Employers’ Liability Act (45 U.S.C. § 51 et seq.) and the Safety Appliance Act (45 U.S.C. § 1 et seq.) defendant Southern Pacific Company appeals from an order granting plaintiff a new trial limited to the issue of damages. The facts relating to plaintiff’s injury may be briefly stated, for defendant does not challenge its liability.
