The plaintiff alleges infringement of two letters patent, No. 609,154, issued August 16, 1898, to Eodge, and No. 763,772, issued June 28, 1904, to Marconi,' and each held by complainant. Defendant denies infringement, and alleges that the claims made by Lodge and Marconi were patented prior to the Lodge and the later Marconi invention or discovery, by the issuance of patents to Marconi, Pupin, Tesla, Fessenden, and various other .patentees.
