‘Without attempting to rehearse the pleadings we may state the nature of the controversy as follows: In the year 1895 one Ellen S. Hale died testate, seised of a five-acre tract of land of the value of $1,500, in firm county. By her will, which was duly probated, she devised a life estate in said land to her brother, Edward J. Hale, with remainder over in equal shares to the First Congregational Church, the Home for Aged Women, and the Home for the Friendless, all of Cedar Rapids, Iowa. The devisee, Edward J.
