Altman, J.), rendered June 14, 1991, convicting defendant, after jury trial, of criminal sale of a controlled substance in the third degree, and sentencing him to an indeterminate term of imprisonment of from &V2 to 9 years, unanimously reversed, on the law, and the matter remanded to Supreme Court for a new trial.
