ORDER AND JUDGMENT ON REHEARING

This matter is before the court on a petition for rehearing of Devine v. Ladd Petroleum Corp., 743 F.2d 745 (10th Cir. 1984). Rehearing was granted, and the court’s previous opinion was withdrawn. The seminal issue upon rehearing is whether this court erred in concluding that the settlement agreement between the partios was not ambiguous as a matter of law.
