The plaintiff, Jerry Word, initiated this action alleging that the DNA Analysis Backlog’Elimination Act of 2000, 42 U.S.C. § 14135b (“the DNA Act”) violates the warrant requirement of the ' Fourth Amendment to the United States Constitution; violates the* special needs exception to the warrant requirement in violation of the Fourth Amendment to the United States Constitution and violates the Ex Post Facto Clause of Article 1, Section 9 of the Constitution.
