Real party in interest Margarita Merced Rodas was granted probahon in 2007 after entering a negotiated plea of no contest to transporting heroin under former Health and Safety Code section 11352. (Unless otherwise set forth, statutory references that follow are to the Health and Safety Code.) At the time, the statute prohibited transporhng a controlled substance for personal use.
