The Town of Kittery (Town) appeals from a judgment of the Superior Court (York County, Fritzsche, J.) reversing the decision of the Town Zoning Board of Appeals (Board) denying the application of Walter and Rosemary Perrin for a wetland setback variance for the purpose of constructing a residence on their Lot 7B.
