WINTER, Circuit Judge:
Gareth West, an inmate at Great Meadows Correctional Facility, alleges that he was seriously injured in a fight with another inmate in the prison’s exercise yard on February 10, 1989. Sometime in late 1989, West filed a pro se negligence action against the State of New York in the New York Court of Claims. On April 2, 1989, West commenced the present action against prison officials under 42 U.S.C. § 1983 (1988). Both actions involved the same incident.
