The issue raised in this case is whether the trial court abused its discretion when it refused to allow Chester Loyde Bird (Bird) to withdraw his pleas of guilty to sexual assault in the first degree, 1 and kidnapping, 2 which were accompanied by his admission of the status of a habitual criminal. 3 At arraignment, the trial court furnished incorrect advice as to the maximum punishment.
