I. NATURE OF CASE

On August 31, 1999, Larry Perry was killed outside his home at the Redman Apartments in Omaha. Earnest D. Jackson was charged with first degree murder and use of a deadly weapon to commit a felony in connection with Perry’s death. A jury found Jackson guilty of first degree murder and not guilty of use of a deadly weapon to commit a felony. Jackson appeals his conviction in case No. S-00-1055. In case No. S-01-051, Jackson appeals the district court’s refusal to grant a new trial based on newly discovered evidence. The cases were consolidated for oral argument.
