LAGUEUX, District Judge.

This matter is before the Court on cross motions for summary judgment. Plaintiffs filed suit pursuant to 42 U.S.C. § 1983 (1994), alleging that restrictions placed on Asterix and Obelix’s entertainment license by the City of Newport (“City”) deprive plaintiffs of their First Amendment right to freedom of expression. The Court held a hearing on plaintiffs’ motion for preliminary injunction and that was denied.
