This is an appeal from an order and judgment setting aside a former judgment in an action brought by appellee against appellant under §405 Burns 1914, §396 R. S. 1881. A demurrer to an amended complaint was overruled. A general denial, accompanied by appellant’s affidavit *in opposition to the petition, was filed, whereupon the cause was submitted to the court for trial, with the result before indicated. A motion for new trial was overruled. The rulings on said demurrer and motion for new trial are assigned as error in this court, and relied on for reversal.
