RICHARDSON, Chief Judge.

During the scholastic year of 1938-1939, while appellant was a student in the junior class at a prominent university, he was called to the dean’s office and apprised of the contents of a letter received from appel-lee. This letter, dated December 30, 1938, charged appellant with being the father of her expected child,, recited his promise- of marriage, his recent letters evidencing a change of mind, and called upon the dean for aid in bringing appellant “to a realization of what he has done”. •
