BRADY, Justice.
On 10 September 2008 a Greene County jury found defendant Aubrey Alberto Mumford guilty of five counts of felony serious injury by vehicle and one count of misdemeanor hit and run, but found defendant not guilty of driving while impaired. After sentencing defendant to a term of imprisonment, the trial court also ordered defendant to pay restitution. To be convicted under N.C.G.S. § 20-141.4(a3), felony serious injury by vehicle, a person must be “engaged in the offense of impaired driving under G.S. 20-138.1 or G.S. 20-138.2.” N.C.G.S. § 20-141.4(a3) (2009).
