Defendant and another were indicted by the grand jury for the crime of murder in the first degree, tried in the district court for Hennepin county before Jelley, J., and a jury which rendered a verdict of guilty as charged in the indictment. From the order denying his motion for a new trial, defendant appealed.

Defendant was convicted of the crime of manslaughter and appealed from an order denying a new trial.
It is contended by defendant: (1) That the evidence is insufficient to justify the verdict, or to show, beyond a reasonable doubt, that defendant is guilty of the crime charged; (2) that the trial court erred in its rulings on the admission and exclusion of evidence, and (3) that there *253was error in the denial of a new trial on the ground of newly discovered evidence.
