SELLERS, Justice.

This suit was filed in the 114th District Court of Smith County by Homer Puckett and wife Nobie M. Puckett who reside in Harris County, Texas, against W. A. Friz-zell who resides in Smith County, Texas.

The suit grows out of a transaction between Plaintiffs Puckett and Defendant Frizzell, whereby the plaintiffs sold to defendant a house and lot in the City of Tyler, Texas. The dispute is over the agreed consideration for the property, it being the plaintiffs’ contention that the defendant agreed to pay them $3,600.00 and assume an outstanding indebtedness against the property…
