1Opinion of the CourtCarlisle, J.
1. While, under the provisions of Code (Ann. Supp.) § 74-403 (Ga. L. 1941, p. 301), no child may be adopted in this State without the written consent of its living parents, such consent is dispensed with where the living parents of a child have surrendered all their rights to the child to a court of competent jurisdiction for adoption. Code (Ann. Supp.) § 74-404 (Ga. L. 1941, p. 301; 1950, pp. 289, 290).
